Elements Of A Robbery
Theft, assault, and the making of threats against a person are all individual crimes. However, the Criminal Code, contains a separate charge combining elements of all of those offences, namely the crime referred to as robbery.
When you imagine a robbery, a group of armed villains surrounding a hapless bank teller, is likely the scenario you have in mind. However, robbery can be much less violent and dramatic than brandishing a gun to steal stacks of cash. Robbery is essentially a theft with an element of and/or threats of violence. So, a robbery could be anything from a mugger to a bully putting someone in a headlock to take their lunch money, no bank required, although stealing from a bank with a gun, does indeed count as a robbery. For the crime of robbery to take place there must be violence, or the threat of violence and there must be a theft (taking of property that does not belong to you).
Robbery is dealt with very seriously, when compared to simple theft, assault and/or threats. Robbery is found at section 344 of the Criminal Code. The Code imposes a maximum penalty of life imprisonment for robbery, however there is no minimum penalty, unless a firearm was used. If a firearm was used in the commission of a robbery, the minimum penalty would be 5 years for a first offence or 7 years for a subsequent offence if the robbery was committed for the benefit of a criminal organization, or 4 years minimum where it was not committed for the benefit of a criminal organization and a firearm was used. Notably the stiffer penalty for a subsequent offence will not take effect if it has been more than 10 years since the first offence. The vast array of sentence lengths for robbery takes into account that the offence can include things from a school-yard strong arming for pocket change all the way up to and including robbing a bank with a gun. As in any sentencing decision a judge will consider all aggravating and mitigating circumstances when choosing a just sentence.
