Normally when you are injured you will have the opportunity to seek compensation through the civil court and/or accident benefits process. However, when you are injured as a result of a violent crime, the accused may have no ability to pay a damage award (particularly if they are incarcerated), leaving victims unable to afford treatment or access compensation.
Given the gap in access to funding, the Ontario government created the Criminal Injuries Compensation Board, a Social Justice tribunal that has the ability to offer up to $25,000 in compensation plus funding for treatment and therapy to victims of violent crime, and families of deceased victims of crime.
Who Is Eligible
In order to be eligible for funding the crime must have taken place within Ontario within the last 2 years unless it was sexual violence. In cases where more than 2 years have elapsed the Board may still hear an application with discretion.
How To Apply
You must fill out the Board’s application package and attach any evidence supporting your injuries. You must also provide any evidence proving the crime took place that the Board will need to consider including police report notes, a conviction record, charging documents, etc. Occasionally you will need to file a Freedom of Information Act request with police before you can obtain said documents.
Once the Board has reviewed your Application they may send additional evidentiary report requests for your health care providers to fill out. The Board does offer some funding to cover report costs.
Once all of the reports have been received the Board will schedule a hearing.
If there has not been a conviction occasionally the Board will notify the alleged offender who would than have an opportunity to participate in the proceeding. A hearing can be scheduled either in person or by phone. The Board member will ask questions of the victim and make a ruling for compensation based on severity of the injuries suffered.
